Participant terms & conditions

The following terms and conditions outline the contest rules, participation, and eligibility criteria for the WheelCoin Initiative and Challenge.

Participation in the challenge implies full acceptance of these terms and conditions. They can be consulted at any time on the website page: https://wheelco.in/challenge-participants-terms-conditions/

All participants in the challenge, by the simple fact of participating, accept the terms and conditions of this challenge, the rules governing their participation, and the terms, conditions, and privacy and data protection policy set out on the registration page of this challenge.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.

DESCRIPTION OF THE CHALLENGE

The participant’s goal is to move as much as possible with sustainable means of transport and record all these trips through the app automatically to accumulate the maximum number of kilograms (kg) of CO2 saved in the WheelCoin app during the period of the challenge.

The organizer will record all the data through the internal database of the app and will show the results daily through the web.

During the challenge, only the Top 10 users with the most CO2 saved will be shown, indicating the amounts accumulated by each one.

At the end of the challenge, the amounts of CO2 saved by each user within the Top 10 will be published.

The users who reach the first three positions in the ranking will be awarded as described in the Prizes and Winner Assignment section.

IDENTIFICATION OF THE ORGANIZING COMPANY.

The challenge is organized by Iomob Technologies OU, registry code 14470136, address Katusepapi tn 6-502, 11412, Tallinn, Estonia, acting under the commercial name WheelCoin (hereinafter referred to as “we” or “Wheelcoin”).

IDENTIFICATION OF THE PARTICIPANTS.

Any user (“participant”) of the WheelCoin app who has submitted the form before the deadline.

The participant is successfully registered when:
– Has filled in the “User email” field with the same address as a valid app user.
– Has filled in the “Nickname” field with a unique name different from any other participant.
– The user has received the confirmation email.

ELIGIBILITY.

All participants who meet all the requirements are eligible to join the challenge.

1. Those Who have successfully registered for the challenge by submitting the form provided on the WheelCoin website will be able to participate.
2. The user must have the app installed and correctly provide the location and physical activity (or similar) permissions.
3. The participant is open to legal residents of their respective countries, where not prohibited by law, who are eighteen (18) years of age or older at the time of entry.
4. Not to be employees of the organizing company or their immediate families (spouse, parent, child, sibling, grandparent, and/or “step” family).

CHALLENGE PERIOD.

The challenge begins on February 15, 2023, at (UTC+00:00 London) and ends on April 15, 2023, at 00:00 (UTC+00:00 London). PDT. (“Contest Period”). All entries (submissions) must be received on or before the time stated during that submission period. The organizer reserves the right to extend or shorten the challenge at their sole discretion.

The registration period will be open until March 30, 2023, at 00:00 (UTC+00:00 London).

Prizes will be awarded within 15 to 30 days after the end of the challenge.

WINNER SELECTION.

Those participants who have saved the most kilos of CO2 individually and through the WheelCoin app registrations will be chosen as winners among all the users registered in the challenge during its duration.

The final list will be published the day after the end of the challenge.

Once finalized, the organizer will communicate via email with the winners. They must respond by the same means within a maximum period of 7 calendar days. If no response is received, the organizer may declare the prize void or give it to the user in the position immediately below. If this user had also been a winner, the lower prize might be declared void or assigned to the user in the place immediately down.

PRIZES.

The first three positions in the ranking will win the following prizes:

First place: Electric folding bike or similar award valued up to $1500
Second place: Electric scooter or similar award valued up to $400
Third place: Electric scooter or similar award valued up to $300

And if you don’t place in the top three, you’re still a green mobility champion in our eyes. Throughout the challenge, ten (10) random winners will receive prizes valued between $50 and $100 towards local, sustainable travel, so even if you can’t hit the jackpot, you could still be a champion!

If any of the prizes cannot be delivered correctly, their value will be transferred by PayPal/Western Union, and if, even so, it cannot be delivered, the prize will be declared null or void.

A participant cannot be a winner of 2 prizes. Therefore, the ranking winners will be excluded from the random prize draw.
Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Official Rules and which may be associated with the award, acceptance, receipt, and use of all or any portion of the awarded prize are solely the responsibility of the respective prize winner. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE IS SOLELY THE RESPONSIBILITY OF THE WINNER.

FRAUDULENT USE.

Any user caught during the challenge manipulating the app or the records taken by the app (such as the use of fake GPS apps, simultaneous use of the account on several devices, etc.) will be considered a fraudulent user.

The organization reserves the right to temporarily/definitely ban, remove from the challenge, close the account, and/or delete the WheelCoins obtained to any user who is considered fraudulent or presents a potentially dangerous activity for the correct function of the challenge, the app or against the interests of the organizer.

LEGAL SCOPE.

All participants are obliged to comply with the legal and tax requirements of their place of residence, in addition to accepting Spanish legislation (EU) as the fundamental basis of the challenge. Any dispute or requirement must be resolved by the courts of Barcelona (Spain, EU).

INDEMNIFICATION AND LIMITATION OF LIABILITY.

BY ENTERING THE CONTEST, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS THE SPONSOR AND ITS PARENT, AFFILIATE, AND SUBSIDIARY COMPANIES, THE TWITTER PLATFORM, ADMINISTRATOR, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE CONTEST AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. SPONSOR AND ITS PARENT, AFFILIATE, AND SUBSIDIARY COMPANIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS, OR MERCHANTABILITY OF THE PRIZE.

PUBLICITY.

By participating, each entrant grants Sponsor permission to use their name, likeness, or comments for publicity purposes without payment of additional consideration, except where prohibited by law.

RIGHT TO CANCEL OR MODIFY THE CHALLENGE.

The organizer reserves the right to cancel or modify any of the terms of the challenge without prior notice. For this purpose, the WheelCoin website is established as the medium for communicating with participants. Participants may not claim any compensation in the event of cancellation or modification of the challenge.
